Terms of Service

Alba Web Hosting provides World Wide Web page hosting and related services (e.g. email). Alba Web Hosting reserves the right to suspend or cancel a customer's access to any or all services provided by Alba Web Hosting when it is decided that the account has been inappropriately used or otherwise.

Server use

Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their own web site to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Alba Web Hosting reserves the right to refuse service and /or access to its servers to anyone.
Alba Web Hosting do not allow any of the following content to be stored on its servers:

• Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any UK, European or USA law.
  
• Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Alba Web Hosting
• Warez - Includes pirated software, ROMs, emulators, phreaking, hacking/cracking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
  

High Resource User Policy
Resources are defined as bandwidth and/or processor utilisation. Alba Web Hosting may implement the following policy to its sole discretion:

When a web site is found to be monopolising the resources available Alba Web Hosting reserves the right to suspend that site immediately.
This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Alba Web Hosting continues hosting the web site for an additional fee.

Payment Policies

All accounts are set up on a prepay basis. Although Alba Web Hosting reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established.
No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the purchase has been made. You must keep us informed of contact changes, if we cannot inform you of payment renewals, your account can become suspended and eventually deleted.

Security

Alba Web Hosting reserves the right to audit the server and to remove any file(s) and/or any scripts that compromises server security without notice.
Such files include ".rhosts", poorly written scripted files, or web based command line tools such as "commandliner".

Payment Options

In order to streamline our accounting procedures and keep costs down Alba Web Hosting runs a limited number of payment options.

Credit / Debit Cards:
Alba Web Hosting accepts MasterCard, Visa via Paypal and NoChex (check their relevant web sites for payment details)

Cheques:
Alba Web Hosting accepts personal cheques drawn on UK banks or building societies only. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of £25.

Payments must be made within a reasonable period of your receiving an invoice or payment request. Failure to do so will result in your account being suspended and eventually deleted. You will be informed beforehand if this happens.

Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to you.

Termination

• If you fail to pay any sums due to us as they fall due, we may suspend the Services and/or terminate this Agreement forthwith without notice to you.
  
• If you break any of these terms and conditions we may suspend the Services and/or terminate this Agreement forthwith without notice to you.
  
• If you are a company and you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to suspend the Services and/or terminate this Agreement forthwith without notice to you.
  
• No refunds will be made for Services suspended in accordance with three paragraphs above
• We reserve the right to suspend the Services and/or terminate this Agreement at any time. In the event of this, you will be entitled pro rata refund based upon the remaining period of membership (a refund only applies when Alba Web Hosting cancels this agreement with you for reasons other than improper use of its services, failure of payment by you as outlined in this agreement).
• You may cancel the Services at any time. During the first 30 days of Services, You are entitled to a complete refund of all fees paid with the exclusion of domain name registration and data transfer fees should You decide to cancel the Services. You will not be entitled to a refund on this basis if you have previously had an account with Sirium.net. No full refunds or pro rata refunds will be made after the first 30 days of service should You decide to cancel the Services.
  Where payments have been made via a NoChex or PayPal account, refunds will be made back to the same account, or via a personal cheque. We may request proof of your identity before refunding any monies.
• On termination of this Agreement or suspension of the Services we shall be entitled immediately to block your Web Site and to remove all data located on it.

Indemnification

The customer agrees that it shall defend, indemnify, save and hold Alba Web Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Sirium.net, its agents, its customers, officers and any employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless Alba Web Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Alba Web Hosting's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Alba Web Hosting's server.

Disclaimer
Alba Web Hosting will not be responsible for any damages your business may suffer. Alba Web Hosting makes no warranties of any kind, expressed or implied for services we provide. Alba Web Hosting disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Alba Web Hosting and any of its employees. Alba Web Hosting reserves the right to revise its policies at any time.
